Description
North Carolina regulates the mortgage business through a single, comprehensive statute: the North Carolina Secure and Fair Enforcement (SAFE) Mortgage Licensing Act, codified at NCGS Chapter 53, Article 19B, and administered by the North Carolina Office of the Commissioner of Banks. The Act states its purpose plainly: to protect consumers seeking residential mortgage loans and to ensure that the industry operates free of unfair, deceptive, and fraudulent practices by mortgage loan originators. For the licensed originator, two things follow from that purpose: a list of acts that are flatly prohibited and a regulator with broad authority to enforce the prohibitions.
This one-hour North Carolina state-specific elective is organized into two chapters. Chapter 1 covers the prohibited acts under the Act and the Commissioner’s disciplinary authority, illustrated by two real North Carolina mortgage-fraud matters. Chapter 2 covers the 2025 modernization of the Act, the set of amendments that took effect on October 1, 2025, so that renewing originators understand what changed and what they must do differently.
